Welcome to OptiPix ("we," "our," or "us"). By accessing or using our website at optipix.in and our image optimization services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and OptiPix. We reserve the right to update, change, or replace any part of these Terms at any time. It is your responsibility to check this page periodically for changes. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.

2. Description of Service

OptiPix provides free online image optimization tools, including but not limited to:

• Image compression and optimization
• Image resizing and dimension adjustment
• Image format conversion (JPEG, PNG, WebP, GIF)
• Image cropping tools
• Batch image processing

All image processing occurs entirely in your browser using client-side JavaScript. We do not upload, store, or access your images on our servers. Our Service is provided "as is" and "as available" without any warranties or guarantees.

3. User Responsibilities and Acceptable Use

3.1 Lawful Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

• In any way that violates any applicable federal, state, local, or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate OptiPix, an OptiPix employee, another user, or any other person or entity
• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
• To process images containing illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content

3.2 Content Ownership

You represent and warrant that you own or have the necessary rights, licenses, and permissions to process any images using our Service. You are solely responsible for ensuring that your use of the Service does not infringe on any third-party rights, including but not limited to copyrights, trademarks, patents, or privacy rights.

3.3 Prohibited Activities

You may not:

• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service
• Use any robot, spider, scraper, or other automated means to access the Service for any purpose
• Introduce any viruses, trojan horses, worms, logic bombs, or other malicious or technologically harmful material
• Attempt to interfere with, compromise, or disrupt the integrity or performance of the Service
• Copy, reproduce, distribute, or create derivative works from any part of our Service without permission

The Service and its original content, features, and functionality are and will remain the exclusive property of OptiPix and its licensors. You retain all rights to images you process using our Service. Since all processing occurs in your browser and images are never uploaded to our servers, we do not claim any ownership or rights to your content. You are solely responsible for the images you process and their subsequent use.

4.3 Feedback

If you provide us with any feedback, suggestions, or ideas regarding the Service ("Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and incorporate such Feedback into our Service without any obligation to compensate you.

5. Privacy and Data Processing

Your privacy is important to us. Our Service is designed with privacy as a priority:

• No Image Upload: All image processing happens in your browser. Your images never leave your device.
• No Storage: We do not store, save, or have access to any images you process.
• Analytics: We use Google Analytics to collect anonymous usage statistics. This data helps us improve the Service.

6. Disclaimer of Warranties

OptiPix does not warrant that:

• Image compression or conversion results will be of any particular quality

7. Limitation of Liability

This includes but is not limited to:

• Loss or corruption of images or data processed through the Service
• Errors or issues arising from browser compatibility or device performance
• Unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or the like that may be transmitted through the Service by any third party
• Any errors or omissions in any content or for any loss or damage incurred as a result of use of any content posted, emailed, transmitted, or otherwise made available through the Service

In no event shall OptiPix's total liability to you for all damages exceed the amount paid by you, if any, for accessing the Service, or one hundred dollars ($100), whichever is less.

You agree to defend, indemnify, and hold harmless OptiPix, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Service, including any data or content transmitted or received by you
• Your violation of any rights of another, including intellectual property rights
• Your violation of any applicable law, rule, or regulation
• Any claim that your use of the Service caused damage to a third party

10. Changes to Service and Terms

We reserve the right to withdraw or amend our Service, and any service or material we provide via the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts located in India.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

13. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and OptiPix regarding your use of the Service and supersede all prior and contemporaneous written or oral agreements between you and OptiPix.
